Welcome to THIBITISHA. By using our application, you agree to these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By downloading, installing, or using THIBITISHA, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the application.
2. Description of Service
THIBITISHA is a mobile application that:
- Automatically captures M-Pesa transaction SMS messages
- Provides transaction management and tracking
- Enables worker management for businesses
- Facilitates payment verification
- Offers wallet top-up functionality
3. Account Registration
To use THIBITISHA, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
4. User Responsibilities
You agree to:
- Use the service only for lawful purposes
- Not share your login credentials with unauthorized persons
- Ensure workers you add are authorized by your business
- Comply with all applicable Kenyan laws and regulations
- Not attempt to reverse engineer or modify the application
5. SMS Permission
By granting SMS permission, you authorize THIBITISHA to:
- Read incoming SMS messages from M-Pesa (MPESA sender only)
- Extract transaction data from M-Pesa confirmation messages
- Store and process transaction information
You can revoke SMS permission at any time through your device settings or the app. Revoking permission will disable automatic transaction capture.
6. Payment Services
Wallet top-up and payment services are processed through Paystack. By using these features, you also agree to Paystack's terms of service. We are not responsible for:
- Payment processing delays by third-party providers
- Failed transactions due to insufficient funds
- Issues with your mobile money provider
7. Service Credits
THIBITISHA uses a credit system for SMS notifications:
- Credits are non-refundable once purchased
- Credits expire after 12 months of account inactivity
- SMS delivery depends on network availability
8. Intellectual Property
THIBITISHA and all related content, features, and functionality are owned by Pewang Company and are protected by intellectual property laws. You may not:
- Copy or modify the application
- Create derivative works
- Reverse engineer the software
- Use our trademarks without permission
9. Limitation of Liability
THIBITISHA is provided "as is" without warranties of any kind. We are not liable for:
- Loss of data or transactions
- Business losses due to service interruptions
- Damages from unauthorized account access
- Issues arising from third-party services
10. Termination
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent activity
- Misuse the service
You may delete your account at any time through the app settings.
11. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms.
12. Governing Law
These terms are governed by the laws of Kenya. Any disputes shall be resolved in Kenyan courts.
